Terms of Use
Version of October 14th, 2026
1. Applicability
These terms of use apply to the application STATASTIC Basketball (hereinafter “APP”) of Statastic Solutions FlexCo, FN 632020t, Schmellau 20, 4493 Wolfern, Austria (hereinafter “FlexCo”). In order to use the APP, you must accept these terms of use.
2. Content of the APP / subject matter of the contract
The APP lets users record actions of basketball games. These actions can be shared with other users through a live ticker link. The ultimate goal of the APP is to provide statistical evaluations of the recorded actions of the respective basketball games.
3. Prices
The prices quoted at the time of ordering shall apply. The prices are stated in local currency (if possible) or Euro and include the statutory value added tax in Austria (gross sales prices). Purchases made via the Apple App Store or Google Play Store are additionally subject to the terms of the respective store operator.
4. Licence and user content
(1) The entire content of the APP is protected by copyright. All rights are held by FlexCo. With the download of the APP, and subject to payment if a paid variant has been chosen, the user receives a simple, non-transferable licence to use the APP for its intended purpose.
(2) Data and content entered by the user (in particular game data, team and player information and stream links) remain the user’s responsibility. The user grants FlexCo the right to store, process and display this content to the extent necessary to provide the APP and its features, in particular the public live ticker.
5. Right of withdrawal
(1) A user who is a consumer may withdraw from a contract within 14 days without giving reasons. The withdrawal period begins on the day of the conclusion of the contract, i.e. the day of the download or purchase of the APP or paid variant.
(2) To exercise the right of withdrawal, the user must inform Statastic Solutions FlexCo, FN 632020t, Schmellau 20, [postal code] Wolfern, Austria, of their decision to withdraw from this contract by means of a clear declaration (e.g. a letter sent by post or an e-mail to office@statastic.info). To comply with the withdrawal period, it is sufficient for the user to send the notification before the period expires.
(3) If the user withdraws from the contract, FlexCo shall refund all payments received from the user without undue delay and at the latest within fourteen days from the day on which FlexCo received the notification of withdrawal. FlexCo will use the same means of payment the user used for the original transaction, unless expressly agreed otherwise. For purchases made via the Apple App Store or Google Play Store, refunds are processed by the respective store operator according to its procedures.
6. Use of game and related data
(1) When the APP is used, FlexCo processes country information, game-related data and live ticker data generated through the use of the APP. This includes, in particular, information relating to games, scores, game events, timestamps, teams, players and other statistical or usage-related data.
(2) FlexCo uses such data to operate, maintain, improve and further develop the APP and related services, and for statistical evaluations, analyses and quality assurance. FlexCo uses data for other commercial purposes only in anonymised and aggregated form that does not allow the identification of individual persons.
(3) Personal data is processed in accordance with applicable data protection law. Details are set out in the Privacy Policy available at https://www.statastic.info/imprint.
7. Live stream links
(1) Users may add to a game a link to a live stream hosted on a platform supported by FlexCo (currently YouTube and Facebook). The stream is then embedded in the publicly accessible live ticker of that game. FlexCo does not host any video content; it merely embeds content hosted by the respective platform provider.
(2) By adding a link, the user warrants that
a) the user or the rights holder is entitled to record and broadcast the game, and no broadcasting or media rights of third parties (in particular leagues, federations or organisers) are infringed;
b) all necessary consents of persons identifiable in the stream have been obtained, in the case of minors in particular the consent of their legal guardians, or the broadcast is otherwise lawful;
c) the linked content contains no unlawful, offensive, discriminatory, pornographic, violence-glorifying or otherwise objectionable material and actually shows the respective game.
(3) The user or the operator of the stream is solely responsible for the content of the linked stream. FlexCo does not adopt linked content as its own. The user shall indemnify FlexCo against third-party claims arising from a culpable breach of the warranties in para. 2, including reasonable costs of legal defence.
(4) FlexCo may remove or block stream links without prior notice if there are concrete indications of a breach of para. 2 or of applicable law, or if FlexCo receives a corresponding notice. In the event of repeated or serious breaches, FlexCo may disable the feature for the user or suspend the user account. FlexCo will inform the affected user of any removal or blocking and state the reasons, unless legal reasons prevent this.
(5) Notice of unlawful content: Anyone who believes that a stream shown in a live ticker contains unlawful content or infringes rights may notify FlexCo at office@statastic.info. The notice should include the link to the live ticker concerned, an explanation of the reasons, and the name and e-mail address of the notifying person. FlexCo will process notices in a timely, diligent and objective manner and inform the notifying person of its decision.
(6) This address is also FlexCo’s single point of contact for authorities and users pursuant to Articles 11 and 12 of the Digital Services Act (Regulation (EU) 2022/2065). Communication is possible in German and English.
(7) There is no entitlement to the display of a stream or to its uninterrupted availability, which depends on the respective platform provider.
8. Contract duration and termination
(1) The contract is concluded for an indefinite period.
(2) The user may terminate the contract at any time by deleting their user account or by notifying FlexCo at office@statastic.info. Paid subscriptions concluded via the Apple App Store or Google Play Store are cancelled via the respective store; the subscription then ends at the end of the current billing period.
(3) FlexCo may terminate the contract with four weeks’ notice. Any prepaid fees for periods after the termination date will be refunded on a pro rata basis.
(4) The right of either party to terminate for good cause without notice remains unaffected. Good cause for FlexCo exists in particular in the event of serious or repeated breaches of these terms of use.
9. Liability
(1) FlexCo makes every effort to ensure the APP works correctly. However, errors or incorrect data (statistical, individual or system failures) cannot be completely ruled out. FlexCo does not warrant that the APP is available at all times, error-free, up to date or executable on every software or hardware configuration.
(2) FlexCo is liable without limitation for damage caused intentionally or through gross negligence, and for personal injury. FlexCo’s liability for damage caused by slight negligence is excluded; this does not apply to personal injury.
(3) Insofar as FlexCo’s liability is excluded or limited, this also applies to the personal liability of its employees, representatives and vicarious agents.
(4) FlexCo accepts no liability for the content of external websites or streams linked to from the APP (see also section 7).
(5) Users must comply with applicable law when using the APP, in particular data protection law, when entering data about third parties such as players.
10. Amendments to these terms of use
FlexCo may amend these terms of use for objectively justified reasons, in particular due to changes in the law or new features of the APP. Users will be informed of amendments in the APP before they take effect. Continued use of the APP after an amendment requires the user’s acceptance of the amended terms of use. If the user does not accept the amended terms, they may terminate the contract in accordance with section 8.
11. Place of performance
The place of performance for the services offered is Wolfern, Austria.
12. Applicable law / place of jurisdiction
(1) Austrian law shall apply, to the exclusion of its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law does not deprive them of the protection afforded by mandatory provisions of the law of the country in which they have their habitual residence.
(2) For disputes with entrepreneurs, the court with subject-matter jurisdiction for Steyr, Austria, shall have exclusive local jurisdiction. For consumers, the statutory place of jurisdiction applies; if the consumer has their domicile or habitual residence or place of employment in Austria, only the courts in whose district this is located may be invoked against them.
13. Severability
Should individual provisions of these terms of use be or become invalid, the validity of the remaining provisions shall remain unaffected.
14. Marketing communication
FlexCo will send information about new features or other offers by e-mail or push notification only if the user has given separate consent to this (e.g. via an opt-in in the APP or newsletter registration). This consent can be revoked at any time with effect for the future, for example via the unsubscribe link in each e-mail or in the APP settings.
Withdrawal
If you wish to withdraw from the contract, please send an e-mail to office@statastic.info.
